AGREEMENT TO OUR LEGAL TERMS

We are Sunset Studios LLC, doing business as Sunset Studios ("Company," "we," "us," "our"), a company registered in California, United States, at 29877 Solardo Dr., Menifee, CA 92585.

We operate the Jot service (the "Service"), an expressive Markdown and HTML editor, which offers local, secure file storage. These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Sunset Studios LLC, concerning your access to and use of the Service. By accessing the Service, you agree to abide by these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We will provide you with prior notice of any scheduled changes to the Service. The modified Terms will become effective upon posting or notifying you via email. By continuing to use the Service after the effective date of any changes, you agree to be bound by the modified terms.

1. OUR SERVICE

The Service is provided for personal, non-commercial use only. You agree not to use the Service in any jurisdiction where such use would be contrary to law or regulation.

2. USER REPRESENTATIONS

By using the Service, you represent and warrant that:

Basic usage at no cost.

4.2. Jot Standard

$4.99 per month unless cancelled. Subscription renews automatically at the end of each month.

4.3. Jot Pro

$9.99 per month unless cancelled. Subscription renews automatically at the end of each month.

You agree to provide current, complete, and accurate purchase and account information. You authorize us to charge your chosen payment provider for any amounts upon placing your order.

5. REFUND POLICY

You can cancel your subscription at any time. No refunds are issued for months already paid, under any circumstances.

6. PROHIBITED ACTIVITIES

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include unauthorized XSS attacks on third-party sites and services, and other activities outlined in this section.

7. PRIVACY AND SECURITY

Files are stored using browser-based local storage technologies and are never uploaded to any server, ensuring your data remains local and secure.

8. MODIFICATIONS AND INTERRUPTIONS

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We will not be liable for any modification, price change, suspension, or discontinuance of the Service.

9. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the State of California. Any disputes arising from these Terms will be resolved in the courts of California.

10. DISPUTE RESOLUTION

Informal negotiations will be conducted for at least thirty (30) days before initiating arbitration. If unresolved, disputes will be resolved by binding arbitration in Riverside, California, under the rules of the American Arbitration Association (AAA).

11. DISCLAIMER

The Service is provided on an as-is and as-available basis. We disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. LIMITATIONS OF LIABILITY

We will not be liable for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, arising from your use of the Service.

13. INDEMNIFICATION

You agree to indemnify and hold us harmless from any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, arising from your use of the Service or breach of these Terms.

14. USER DATA

We will maintain certain data that you transmit to the Service for the purpose of managing the performance of the Service. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Service.

15. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

16. MISCELLANEOUS

These Terms constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
